UDA’s Sakaja and Wiper’s Wavinya cleared for August polls

Tribunal says it lacks jurisdiction to authenticate their degree certifications

The Independent Electoral and Boundaries Commission (IEBC) disputes tribunal has dismissed a petition seeking to bar Nairobi Senator Johnson Sakaja from vying for the Nairobi Governor seat over the validity of his degree. Earlier on the same tribunal also threw out a petition challenging the degree of Wiper gubernatorial candidate for Machakos Wavinya Ndeti and cleared her to be on the ballot.

The decisions were made a day after the Director of Public Prosecutions (DPP) Noordin Haji directed the Inspector-General of Police Hillary Mutyambai to expedite the investigation into the academic certificates held by the two politicians including all others with questionable academic papers.

In the ruling made on Sunday 19th June, 2022, the electoral body said it doesn’t have the legal mandate to  investigate and verify the validity of academic credentials for political aspirants sing that such mandate belong to the Commission for University Education (CUE) and the police.

Sakaja’s woes intensified last week when the Chairman of the Commission for University Education (CUE) Professor Chacha Nyaigotti Chacha revoked the recognition it had given to Sakaja’s Bachelor of Science in Management Degree from Uganda’s Team University. The decision was however suspended by the High Court which also barred the IEBC from striking Sakaja’s name from the list of gubernatorial candidates for Nairobi county.

In other news, the tribunal locked out UDA Kiambu Senate Aspirant Karungo Wa Thang’wa from the August polls saying that the aspirant had been impeached and was therefore disqualified from ever holding public office. The tribunal dismissed Karungo’s assertion that he had resigned before his impeachment and upheld the Kiambu Returning Officer’s decision not to clear him.
